No Performance Guarantee

We make no guarantees regarding the percentage of content that will pass any specific AI detection tool. Any success rates referenced in our marketing materials are based on internal testing conducted at a point in time and may vary based on input content, detection tool updates, and other factors beyond our control. Such references constitute general marketing statements and are not contractual commitments, warranties, or guarantees of future performance.

4. Eligibility

To use our Service, you must:

6. Subscription Plans, Billing, and Credits

6.1 Subscription Plans

We offer various subscription plans with different features and word limits. Plan details and pricing are available on our pricing page. All prices are in US dollars unless otherwise stated.

6.2 Billing

Subscriptions are billed on a recurring basis (monthly or annually) depending on your selected plan
Payment is due at the beginning of each billing cycle
All payments are processed securely through Stripe
You authorize us to charge your payment method for all fees associated with your subscription, including recurring charges, until you cancel

6.3 Word Credits

Each subscription plan includes a monthly allocation of Word Credits. Word Credits:

Are deducted based on the input text length when you use the humanization service
Reset at the beginning of each billing cycle
Do not roll over to the next billing period
Are non-refundable, non-transferable, and have no cash value
Cannot be sold, exchanged, bartered, or converted to currency
Are forfeited upon account cancellation or termination

6.4 Free Tier

We may offer a limited free tier at our discretion. The free tier is subject to availability, and we reserve the right to modify, limit, or eliminate it at any time without notice. Abuse of the free tier — including but not limited to creating multiple accounts or circumventing device-level usage limits — will result in immediate account termination.

7. Refund Policy and Payment Disputes

7.1 All Sales Are Final

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. Due to the digital and immediately-consumable nature of our Service, all sales are final.

By subscribing to or purchasing any aspect of the Service, you acknowledge that you receive immediate access to digital content and services, and you expressly waive any right to a refund, cooling-off period, or right of withdrawal to the maximum extent permitted by applicable law.

This applies to, without limitation: subscription fees, Word Credits, plan upgrades, plan downgrades, and any promotional or discounted purchases.

You may cancel your subscription at any time through your account settings. Cancellation stops future billing at the end of the current billing period but does not entitle you to a refund for the current or any prior billing period. Any remaining Word Credits at the time of cancellation will remain available until the end of your current billing period and will then be forfeited.

7.2 Chargebacks and Payment Disputes

You agree to contact us at support@humanizethisai.com before initiating any chargeback, payment dispute, or claim with your bank, credit card company, or payment provider.

If you initiate a chargeback or payment dispute without first contacting us and allowing a reasonable resolution period (minimum 14 days):

Your account will be immediately suspended pending investigation
All unused Word Credits will be permanently forfeited
If the dispute is resolved in our favor, your account may be permanently terminated
We reserve the right to pursue recovery of any amounts owed, including costs, fees, and expenses associated with the dispute
We may report fraudulent chargebacks to relevant fraud prevention services and databases

By subscribing to our Service, you acknowledge that filing a chargeback or payment dispute for services that were delivered as described constitutes a breach of these Terms.

7.3 Billing Errors

In the event of a verified technical error resulting in duplicate charges, or charges for services not rendered due to a confirmed system failure on our end, we will issue an account credit or billing adjustment. To request a billing error review, contact support@humanizethisai.com with your transaction details within 30 days of the charge.

8. Acceptable Use Policy

HumanizeThisAI is a writing enhancement tool designed to improve the natural quality and readability of text. You are solely responsible for ensuring your use of the Service complies with all applicable laws, regulations, and the policies of any institution, employer, or platform.

You may NOT use our Service to:

Violate any applicable laws, regulations, or third-party rights
Submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or objectionable
Use the Service in any manner that would constitute fraud, misrepresentation, or violation of applicable law
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Interfere with or disrupt the Service or servers connected to the Service
Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems
Use automated systems, bots, scrapers, or other programmatic means to access the Service without express written permission
Resell, redistribute, sublicense, or provide access to the Service to third parties
Circumvent or attempt to circumvent usage limits, bans, or access restrictions
Generate content intended to deceive, defraud, or cause harm to others
Reverse engineer, decompile, or attempt to extract the source code of the Service

We reserve the right to suspend or terminate your access if we reasonably believe you have violated this Acceptable Use Policy, without prior notice and without refund.

AI DETECTION TECHNOLOGY IS CONTINUOUSLY EVOLVING AND RESULTS MAY VARY. ANY MARKETING CLAIMS REGARDING SUCCESS RATES ARE BASED ON INTERNAL TESTING AT A SPECIFIC POINT IN TIME AND DO NOT CONSTITUTE WARRANTIES OR GUARANTEES OF FUTURE PERFORMANCE.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUMANIZETHISAI AND ITS OPERATORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify, defend, and hold harmless HumanizeThisAI and its operators, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) Content you submit to the Service; (e) your use or distribution of Output generated by the Service; or (f) any chargeback or payment dispute initiated by you.

14. Account Termination

14.1 Termination by You

You may cancel your subscription at any time through your account settings. Cancellation is effective at the end of the current billing period. No refunds will be issued for the current or any prior billing period. Unused Word Credits will be forfeited at the end of the billing period.

14.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, for any reason or no reason, with or without notice. Grounds for termination include, but are not limited to:

Violation of these Terms or our Acceptable Use Policy
Suspected fraud, abuse, or illegal activity
Filing a chargeback or payment dispute
Creating multiple accounts or circumventing usage limits
Abusive behavior toward our team or other users
Non-payment or failed payment for a Subscription
Extended inactivity

14.3 Effect of Termination

Upon termination: your right to use the Service immediately ceases; all unused Word Credits are permanently forfeited; we may delete your account data in accordance with our Privacy Policy; and no refund of any kind will be issued.

Sections 7 (Refund Policy), 10 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), 15 (Dispute Resolution), and 16 (Governing Law) shall survive any termination of these Terms.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at support@humanizethisai.com and allow at least thirty (30) days for good-faith resolution of the dispute.

15.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any aspect of our relationship (collectively, "Disputes") that cannot be resolved informally shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

15.3 Class Action and Jury Trial Waiver

YOU AND HUMANIZETHISAI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. You and HumanizeThisAI each waive the right to a jury trial for any Disputes.

If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the Dispute shall be decided by a court.

15.4 Exceptions

Nothing in this section shall prevent either party from: (a) seeking injunctive or other equitable relief in court for intellectual property infringement or misappropriation; or (b) filing a claim in small claims court if the claim qualifies.

15.5 Opt-Out

You may opt out of this arbitration provision by sending a written notice to support@humanizethisai.com within thirty (30) days of first creating your account. The notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, you and HumanizeThisAI agree to resolve Disputes exclusively in the courts specified in Section 16.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of Delaware.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and, where practicable, by sending a notification to the email address associated with your account. Material changes will take effect no earlier than thirty (30) days after posting.

Your continued use of the Service after the effective date of modified Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, your sole remedy is to discontinue use of the Service and cancel your account.

18. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of governmental authorities, pandemics, epidemics, fire, floods, power outages, internet or telecommunications failures, cyberattacks, third-party service provider outages (including but not limited to cloud hosting, AI processing, and payment processing providers), changes in applicable law, or labor disputes.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and HumanizeThisAI regarding the Service.

19.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
